Employer didn't provide hearing protection can I legally do something?
I just started working at a lawn care company and got treated like a slave so im quiting tomorrow but during my brief time working at the company I used lawn mowers and whipper snipers which I have found out instantly cause hearing damage if no ear protection is worn. There was no real training, and no ear protection provided. Now I know the damage is very slight but still I have received hearing damage due to the employer. Can I take legal action for some type of compensation?
No, you did not suffer immediate hearing loss from lawn mowers. You cannot sue for damage which cannot be proven, and there will be zero evidence of impaired hearing.
EDIT: I'll explain this to those below imploring you to get a lawyer.
In order to show hearing damage, you need to have received a baseline hearing test. Even IF you had detectable hearing loss, which is impossible in a 'brief time' using a lawn mower, you would have had to show your hearing BEFORE working there was better. Since I'm betting you can't, you have no case. Just showing less than stellar hearing now means nothing, you have to show any loss was directly related to the work environment.
However, you certainly should have been wearing protection, because long term exposure would have caused problems.
If you want to be a problem, report them to your local Health and Safety organization (OSHA, if you're in the US). Just remember, any bridge you burn cannot be unburned.
